LET’S BE VIVIDLY CLEAR ON THE FDA’S TESTING REQUIREMENTS FOR CANNABIS PRODUCTS:
FOR RETAIL CUSTOMERS:
- What to Look for in Cannabis Products: As a consumer, make sure that brands you purchase from provide clear testing results for phytocannabinoid potency and contaminants.
- This is especially important in states where laws may not enforce testing for all contaminants.
- State Law Variability: Be aware that not all products are held to the same standards. Testing regulations can differ by state, so choose brands that go beyond basic requirements for higher safety and quality.
FOR CANNABIS PRODUCT OWNER’S:
- No Full-Panel Testing Required by the FDA:
The FDA doesn’t mandate comprehensive testing for all potential contaminants; such as pesticides, heavy metals, or residual solvents. So, Federally, you aren’t required. - STATE LEVEL: Full Panel Tests may, however, be required by your local state laws.
- Company Standard: If you have the funds available, you may implement your own company’s quality standards.
AS PER THE FDA: Cannabinoid Potency Testing is required ONLY IF YOU ARE MAKING THERAPEUTIC CLAIMS. If you do market for having therapeutic benefit, your product is now considered a drug and you must fill out a “new drug application (NDA) or abbreviated new drug application (ANDA) process, or (2) for certain over-the-counter nonprescription drugs, meet the requirements in the FD&C Act for marketing without an approved NDA or ANDA.” – FDA.GOV
ADVICE: Don’t make claims and always choose to full panel test your products regardless of requirements if you have the means to do so.

This test will verify that the cannabinoid potency levels of the actual product matches the cannabinoid potency claim found on the product label. I.g.:
A bottle of DELTA-8 GUMMIES has this claim on the product label, “This product contains 25 MG of Delta 8 Per Gummy.” A CPT would verify that claim to ensure that each gummy indeed has 25 mg of Delta 8 per gummy.
